Legal guarantee of conformity

All products sold on Shoppiva are covered by the legal guarantee of conformity that applies in your country of residence. For consumers in the European Union, this guarantee lasts two (2) years, in accordance with the regulations in force.

For consumers living in France, it is governed by Articles L217-3 et seq. of the French Consumer Code (Code de la consommation). Its main rules are as follows:

• it covers lack of conformity that exists at the time the item is delivered (that is, the moment you receive it) and becomes apparent within two (2) years of delivery;
• during this period, you do not have to prove that the defect existed at the time of delivery;
• you can ask for the item to be repaired or replaced, free of charge;
• if repair or replacement is impossible or is not carried out within a reasonable time, you can obtain a price reduction, or the termination of the sale (its cancellation) with a refund if the defect is not minor;
• the legal guarantee on an item repaired under this guarantee is extended by six (6) months.

Guarantee against hidden defects

Independently of the guarantee of conformity, you are covered by the guarantee against hidden defects provided for in Articles 1641 et seq. of the French Civil Code (Code civil).

It covers hidden defects that make the item unfit for its intended use, or that reduce that use so much that, had you known about them, you would not have bought it or would have paid less for it.

You can bring a claim within two (2) years of discovering the defect. You may then choose between the termination of the sale (its cancellation, with a refund) and a price reduction, in accordance with Article 1644 of the French Civil Code.

Exclusions

Damage resulting from misuse, use that does not follow the instructions, or normal wear and tear is not covered by these guarantees.

Extended commercial warranty

We also offer, on an optional basis, an extended commercial warranty of one (1) year, which is added to the existing legal guarantee. It covers manufacturing defects in the product concerned.

The extended warranty is provided by CPM Consulting FZ LLC, A1-1210A Building no. A1 Al Hamra Industrial Zone-FZ, Ras Al Khaimah, AE. How to take it out and how it is billed are set out in Article 8 of our Terms and Conditions of Sale and Use.

Regardless of the extended warranty, and whether or not you take it out, the seller remains bound by the legal guarantee of conformity referred to in Articles L217-3 to L217-20 of the French Consumer Code and by the guarantee relating to defects in the item sold (guarantee against hidden defects), under the conditions laid down in Articles 1641 to 1649 of the French Civil Code, described above.

What the extended warranty does not cover

In addition to the exclusions set out above (misuse, use that does not follow the instructions provided, normal wear and tear of the product), the extended warranty does not cover:

• modifications or repairs carried out by you or by a third party;
• accidental breakage, loss and theft.

Cancelling the extended warranty

You can cancel the extended warranty free of charge within 24 hours of purchase by writing to us at contact@shoppiva.com. If the cancellation is accepted, the refund is processed within the same period as an order cancellation (see Article 7 of our Terms and Conditions of Sale and Use).

This option to cancel is in addition to the fourteen (14) day right of withdrawal you have for any distance contract, under the conditions laid down in Articles L221-18 et seq. of the French Consumer Code.

How to make a warranty claim

If the product has a manufacturing defect or does not conform, whether you are claiming under the legal guarantee or the extended warranty, contact us by email at contact@shoppiva.com, stating:

• your order number;
• detailed photos of the defect;
• a precise description of the problem.

Our team will review your request and arrange, as appropriate, the repair, replacement or refund of the product concerned. The return costs for a product covered by the legal guarantee are covered by us.
